By signing up for this course, I agree to the following liability waiver. If the participant is a minor, then the parent/legal guardian agree to the following liability waiver.

THE FREEDOM ACADEMY, INC.

Waiver, Release of Liability, Indemnification, and Consent To Medical Attention

In exchange for my being allowed to participate in the educational program of the Freedom Academy, Inc. (the “Academy”). I and, if I am not yet 18 years old, my parent or legal guardian (individually and collectively referred to in the registration process in the first person singular) agree to be bound by each of the following:

1. Identification of Risk. I understand that my participation in the Program and/or Activity my involve risk of injury and loss, both to person and to property. I further understand that the risk of injury may include the possibility of permanent disability and death. I understand that the premises, facilities, and equipment used in conducting the Program’s educational activities are owned , maintained, or controlled by Community Learning Center/Freedom Academy (the “Premises Owner”) and that the Academy does not own, maintain, or control the premises, facilities, or equipment. I further understand that I may be at risk in using such premises, facilities, and equipment. There may be other risks not known to the Academy or Premises Owner or not reasonably foreseeable at this time. I understand that these risks of injury and loss might result from the actions, inactions, negligence, or conduct of the Academy, the Premises Owner, or others, the rules of the Program and/or Activity, or the condition of the premises, the facilities, or any equipment used in the Program and/or Activity.

2. Assumption of Risk. I assume all risks, known and unknown, in any way connected with my participation in the Program and/or Activity. I accept personal responsibility for any liability, injury, loss, or damage in any way connected with my participation in the Program and/or Activity.

3. Waiver and Release. I waive and release the Academy, the Premises Owner, and their directors, officers, sponsors, employees, agents, volunteers, successors, and assigns from all claims for any liability, injury, loss, or damage in any way connected with my participation in the Program and or Activity, whether or not caused in whole or part by the negligence or other misconduct of any of the organizations or individuals mentioned above.

4. Indemnification. I agree to indemnify and hold harmless (in other words reimburse and be responsible for) the Academy, the Premises Owner, and their directors, officers, sponsors, employees, agents, volunteers, successors, and assigns from all claims for any liability, injury, loss or damage in any way connected with or arising out of my participation in the Program and/or Activity, whether or not causes in whole or in part by the negligence or other misconduct of any of the organizations or individuals mentioned above.

5. Binding Effect. This instrument shall be binding upon my relatives, personal representatives, heirs, beneficiaries, next of kin, or assigns and shall inure to the benefit of the Academy, the Premises Owner, and their respective successors and assigns.

6. Consent to Medical Treatment. I agree that the Academy or Premises Owner may provide to me, through medical personnel of their choice, customary medical assistance, transportation, and emergency medical services. This consent does not impose a duty upon the Academy or the Premises Owner to provide such assistance, transportation, or services.

7. Invalidity/Unenforceability. If any provision of this instrument is held to be invalid or unenforceable, this instrument shall be constructed as if such invalid or unenforceable provision was not contained herein.

8. Applicable Law. Because the Academy and Premises Owner are located in Indiana, and in order to provide certainty in the law to be applied to the construction of this instrument, this instrument shall be governed, construed, and enforced in accordance with the law of the State of Indiana.

I HAVE READ THIS WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT. I AM SIGNING THIS WAIVER, RELEASE OF LIABILITY, INDEMNIFICATION, AND CONSENT VOLUNTARILY.

If the person participating in the Program and/or Activity is not 18 years old: As parent or legal guardian of the above-named individual, I verify that I fully understand, agree to, and accept all provisions of this Waiver, Release of Liability, Indemnification, and Consent Voluntarily.

Fee Refund Policies: Materials, textbooks, pre-screening fees, registration fees, credit card fees, testing fees and safety equipment fees are NOT refundable. Additionally, there are NO refunds for the following classes/courses: *Courses 12 Hours or less *CNA, CCMA, & QMA classes (Pre-screening fees will be charged to the student if they are unable to attend class for any reason. If the student fails their physical or drug screen, they will be responsible for all pre-screening fees and will not be able to attend class. *Courses 13 Hours or longer: *Full tuition fee refundable if cancellation is made 7 days prior to the first class session *1/2 tuition fee refundable prior to the second class session *No tuition fee refund after 2nd class session *No credit card transaction fees will be reimbursed ONSITE Training: Course payment is required before the start of each class or event. For your convenience, payments may be made over the phone, cash, check or money order. Course prices are subject to change. Refunds are not provided for onsite training unless the class or event is cancelled by Freedom Academy.
